Rideshare apps like Uber and Lyft previously did not provide their drivers with insurance because they were considered independent contractors. Instead, they required their drivers to obtain their own auto coverage. Now, however, Uber provides certain coverage to drivers who are working in the app. Depending on the details of the accident either Uber, the driver, or another party could be held liable for an accident. Is Connecticut a No-Fault Accident State?
In a no-fault accident state, drivers who are injured in a car accident must seek compensation through their own insurance regardless of who caused the crash. Connecticut is not a no-fault state. Drivers in CT can file a claim or lawsuit to pursue damages from the negligent driver’s insurance to cover both medical expenses and property damage. In an accident involving an Uber, either the Uber driver, another driver, or Uber can be liable for associated costs.
Is the Driver Liable in an Uber Accident?
If an Uber driver is in their vehicle but is not driving for work purposes, they will be liable if they are negligent in an accident. When the app is not open they are not on the clock so any crash or collision is not technically the responsibility of Uber.
If the driver is working and gets into an accident they may be able to hold another driver responsible for negligent behavior. However, they are also covered by Uber’s own insurance. Uber offers the following coverage depending on the coverage period the driver is operating in when the accident takes place.
When the driver is offline
As established, if the driver is not driving for Uber at the time of the accident they are only covered by their personal auto insurance.
When the driver is online and available for a ride
In this case, Uber provides third-party liability insurance to cover the cost of damages and injuries in the following amounts.
- $50,000 per person for bodily injury
- $100,000 per accident for bodily injury
- $25,000 per accident for property damage
When the driver is en route or driving a passenger
If the driver has accepted a ride or has a passenger in the vehicle Uber will cover:
- $1,000,000 in property damage and injuries for riders and third parties when the driver is at fault
- The costs to repair the driver’s car up to the cash value (with a $2,500 deductible)
Depending on your state Uber may also provide coverage for uninsured or underinsured drivers, personal injury protection, and medical payment coverage for both the driver and passengers regardless of who was at fault.
